ORDER

Dated Aizawl, the 17^th April, 2023

Whereas, during the course of conduct of General Election to Members of District Council under Chakma Autonomous District Council, 2023, there is every likelihood that the Chakma Autonomous District Council (Constitution, Conduct of Business, etc.) Rules, 2002 as amended, may be vague or silent in matters related to the process of a particular matter; and

Whereas, the Commission is of the view that such vagueness or silence in the Chakma Autonomous District Council (Constitution, Conduct of business, etc.) Rules, 2002 as amended, may undermine the smooth preparation for conduct of free and fair polls;

Now, therefore, in exercise of the powers conferred under sub-rule (5) of Rule 7 of the Chakma Autonomous District Council (Constitution, Conduct of Business, etc.) Rules, 2002 as amended and with a view to ensuring smooth, free and fair elections, the State Election Commission hereby orders that wherever the Chakma Autonomous District Council (Constitution, Conduct of business, etc.) Rules, 2002 as amended, is vague or silent on any matter pertaining to the preparation for and conduct of election, provisions of the Representation of the People Act, 1951 (Act No.43 of 1950), Conduct of Election Rules, 1961 and Guidelines & Instructions issued by the Election Commission of India wherever applicable is to be adopted.
